Eastern Washington University (EWU) offers WordPress services (“Services; Service”) to current faculty or staff of EWU (“Users"). The use of these Services is subject to the Terms of Use (“Terms”) contained herein. You must read and agree to these Terms, including any future amendments.

We will attempt to notify you when major changes are made to these Terms, however, users should periodically review this document as EWU may, in its sole discretion, modify or revise these Terms at any time. If you do not accept and abide by these Terms, you may not use the Services.

I – Disclaimer

Content published through WordPress Services may include un-moderated dialogue containing the personal opinions and expressions of the Users who submitted the entries. Neither the content, comments, nor the links to other websites, are reviewed, approved, or endorsed by EWU. Furthermore, EWU does not guarantee the truthfulness, accuracy, or reliability of any communications posted, submitted or displayed through the Service.

Although EWU does not routinely monitor content posted by Users, EWU reserves the right to remove content that violates these Terms, but is under no obligation to do so.

II – Description of Service

Eastern Washington University offers WordPress Services in support of EWU related communications conducted by the University community. These Services are made available to any current faculty or staff of EWU subject to the terms and conditions of use.

A blog is a website maintained by an individual or individuals, with regular entries consisting of commentary, descriptions of events, and/or other content such as graphics, photos, or audio/video clips.

The Service is provided to Users on an “as-is” and “as-available” basis. EWU reserves the right to modify, suspend, or discontinue the Service with or without notice at any time and without any liability to its Users.

III – Proper Use

Blog or site owners who allow comments are required to review and approve comments on their site to ensure adherence to this Terms of Use. Site administrators (owners) who violate this policy will be subject to deactivation of service until corrected. Moderation of comments is turned on by default.

Users are responsible for maintaining the confidentiality of their account and password and accept responsibility for all activities occurring under their account. Users agree that they will not access or attempt to access any other User’s account, or misrepresent or attempt to misrepresent their identity while using the Services.

Users may post content freely through the Services provided by EWU, so long as the content is not illegal, obscene, defamatory, threatening, infringing on another’s intellectual property rights, or otherwise injurious or objectionable. Users agree to use the Service in compliance with all applicable local, state, and national laws and all EWU policies, including but not limited to the following:

Violation of any of the foregoing policies may result in immediate termination of this agreement, and may subject you to state and federal penalties.

By posting content to any blog, Users warrant and represent that they either own or otherwise control all of the rights to that content, including, without limitation, all the rights necessary for them to provide, post, upload, input or submit the content, or that their use of the content is a protected fair use. Users agree that they will not knowingly and with intent to defraud provide material and misleading false information. Users represent and warrant also that the content they supply does not violate these Terms, and that they will indemnify and hold Eastern Washington University harmless for any and all claims resulting from content they supply.

Plugin Specific Use Policies

Google Analytics For WordPress

Site administrators who elect to activate the "Google Analytics for WordPress" plugin agree to abide by all terms and conditions of the Google Analytics service as described in their current terms of service http://www.google.com/analytics/tos.html and understand that it is a free service that could change or be removed at any time. Users further agree to use the tool as it was intended and take full responsibility for its configuration.

Gravity Forms

Site administrators who elect to activate the "Gravity Forms" plugin agree and acknowledge that the plugin, its configuration (beyond the initial configuration provided by EWU WordPress Services), and functionality are the sole responsibility of the site administrator, site owner, and the site on which it is being used. Further, site administrators agree to adhere to the EWU Privacy Policy, Intellectual Property Policy, Social Media Policy, FERPA Policy, and the latest regulations concerning EWU Appropriate Use of University Facilities, Equipment and Information.

Slickr Flickr

Site administrators who elect to activate the "Slickr Flickr" plugin agree to abide by all terms and conditions of the Yahoo Flickr service as described in their current terms of service http://info.yahoo.com/legal/us/yahoo/utos/utos-173.html and understand that it is a free service that could change or be removed at any time. Users further agree to use the tool as it was intended and take full responsibility for its configuration and use.

IV – Intellectual Property Rights

Users retain all patents, trademarks and copyrights to any content posted, submitted, or displayed through these Services and are responsible for protecting those rights, as appropriate.

By posting, submitting or displaying content through the Services provided by EWU, Users are granting EWU a non-exclusive, royalty-free, perpetual, and worldwide license to use the content without limitation, including the rights to copy, distribute, transmit, publicly display, reproduce, edit, and reformat the content. Furthermore, EWU may incorporate your content into a collection of work at any time.

When publicly displaying, distributing, or reproducing your content, EWU will make best efforts to credit the User. Users agree to allow EWU to use their name or likeness for such purposes.

V – Termination, Suspension of Service

EWU may, at its sole discretion, at any time and for any reason suspend or terminate a Users account, amend these Terms, or terminate the Service. In the event of termination, access to the account will be disabled and any content contained within may (but is not guaranteed to) remain in our system for back-up purposes.

VI – Indemnification

Users agree to hold harmless and indemnify EWU, any of its subsidiaries, affiliates, and employees from and against any third-party claim arising from or in any way related to the violation or use of the Service. This indemnification includes any liability or expense arising from all claims, losses, actual or consequential damages, suits, judgments, and litigation costs or attorneys’ fees.

VII – Accessing

All content posted to the Services is the sole responsibility of the individual who originally posted the content. All opinions expressed are not necessarily the opinions of Eastern Washington University.

Eastern Washington University will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred as a result of use of any content posted on this site. Users must evaluate and bear all risks associated with the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

VIII – Agreement

These Terms constitute the entire agreement between the User and EWU and governs the use of the Services. These Terms supersede any and all prior oral or written agreements with the Users.
